Job owes my husband money and won't pay it, what can I do?
Hey everyone, here is some background info. I’m sorry this is so long, but I really need some help.
He worked at a restaurant in Georgia.
He has now quit that job because of this issue just 2 weeks ago.
I spoke to the DOL about it and since he made over minimum wage they can’t enforce anything. I called the restaurant… but there has been some bad blood. They tell me that because the manager that gave him his raise wasn’t authorized to do so that my husband isn’t owed the money.
How the money ended up missing is that every paycheck since Sept. 09′ had him clocked in for a couple of hours at his "old" lesser hourly wage. And they told me that this corporation had a strict rule about no one getting over a $0.65 raise, but my husband got a dollar they say because the manager went about it wrong and said manager was demoted. Might I add that AFTER this manager was demoted to another restaurant that my husband STILL received his $1.00 raise even on his very last paycheck.
When my husband worked there, his direct manager said he would correct the issue.
It added up to a total of $85 and some change.
To sue in small claims it would COST $71. I don’t mind suing… I can save up that money in a few weeks. I’m just in tears right now because it hurts my heart to know that they can get away with this. Does ANYONE have any thoughts? A battle plan? A recommendation? ANYTHING would help right now! It’s not right that there is nothing to protect people who don’t have the money to sue you know.

It’s not clear to me how you are arriving at the conclusion that he was shortchanged $85. At some unspecified point in time in the past your husband was given a raise in his hourly wage of $1.00. You seem to be saying that since September 2009 he was being paid $1.00 less an hour for some of his hours and still getting paid the $1.00 increase on the rest of his hours. Is the shortage based on:
1. The belief that he should have been entitled to the $1.00 per hour increase in wage since September 2009 for all hours regardless of whether it was properly authorized (you would lose this argument in court); or
2. The belief that he should have been entitled to the maximum $0.65 raise?
Also is the $85 dollar shortfall the total for his wages from September until the date he quit, or is it $85 per pay period? If it is the former it really doesn’t seem worth the effort to pursue a claim in court. If it is the latter it might be worth it because he could potentially recover several hundreds of dollars but you have to consider whether he could actually win the case.
If your husband is paid an hourly wage he is most likely an at-will employee which means the restaurant can adjust his wages in any manner it pleases as long as they are not adjusted below minimum wage and as long as it notifies him of the change prior to any hours worked for which it starts to pay the lower wage. If there is nothing in writing memorializing the decrease in hourly wage, the resolution of the claim will depend on whom the magistrate believes is telling the truth about what the restaurant said to your husband regarding the reduction in hourly wage and when it occurred.
While it is not relevant to his situation, one can bring a small claim in the Magistrate Court of the appropriate county for a claim of up to $15,000, not $5,000.
In Magistrate Courts in Georgia, either party can have a lawyer represent them in court. The owner does not have to show up in court. While cases generally proceed much faster in a Magistrate Court, it can still take several months from the time a claim is filed to resolve the claim in court. In addition, the losing party has a right to appeal to a higher court which can delay resolution of the claim for another month or more.
You should also be aware that, when filing against an incorporated defendant, which is what the restaurant probably is, you have to file your claim in the Magistrate Court of the county where the registered agent of the corporation is located. This is often not the county where the restaurant is located. You should get the legal name of the corporation that owns the restaurant (it is often not the the same name as the restaurant’s name) and look up the county location of the registered agent online at http://sos.georgia.gov/corporations/ if you decide to go forward with a claim against the restaurant. One way to find out the legal name is to visit the restaurant and look at the restaurant’s liquor license or other permits or licenses which might be conspicously displayed to the public.

I live in the UK so not sure if same applies but you can take them to a work tribunal which should be funded by the state. A tribunal is an informal meeting between the two parties where a facilitator will over look the proceedings, and make a decision. Hope this helps at all.

$85 is $85 but it might really be easier in the long run to just mark this down to a learning experience. You said you contacted the DOL was that the federal or state DOL. If it was the Federal you might consider contacting the state’s version.

Small claims court is your best bet if the total you’re asking for is under $5000.
If you want to be nice, inform the restaurant’s management that if they refuse to pay, you will take them to court. If they refuse, or don’t answer within a reasonable amount of time (I think a week is reasonable) then go ahead and file. Don’t just say "Gimme money or we’ll sue!", prepare a proper complaint letter along with evidence showing what is owed. If that doesn’t work, then go ahead and file.
Neither you, nor the restaurant, can use a lawyer in court. The owner MUST show up to defend himself, or the judge will automatically find in your favor. There is no jury. You show up, present your case and evidence, the owner of the restaurant will do the same, then the judge issues a decision. If you’ve seen those "Judge So-and-so" type shows on TV, it’s pretty much like that – just without the actors.
While you can’t ask for "pain and suffering" like most lawsuits do, you can (and should!) ask for the actual amount due, the cost of filing the case ($71) plus wages for missing work that day to show up to court.
Gather your old paychecks and any other evidence of the raise and how it’s missing.
More than likely, the restaurant will try to settle before the case shows up in court. If so, at least get the amount due and the cost of the filing.
Of course the restaurant may still refuse to pay even after judgment has been levied against them. In that case, you may want to call your local news station’s trouble shooter. You know, that segment where the reporter goes out and asks the owner of a local company why he’s screwing over a local viewer? Even if you never get any money out of the deal, the negative publicity alone will essentially bankrupt the restaurant or at least force that owner out of business.

Baggio was the most gifted but became mentally unstable after ‘94. However, those first 4 years he had in the decade were superior than anything Romario or Cantona did.

Romario, with Baggio and Cantona falling just short. Cantona is rightly considered to be one of our best ever players at Old Trafford, but Baggio was definitely on that level. When Romario was on top of his game he was absolutely unplayable – the WC in 1994 is the first WC which I have detailed memories of and he was outstanding for Brazil, and brilliant for Barca around the same time. Finished with an incredible record of 70 caps and 55 goals. Cantona and Baggio were more complete players than Romario, but like I say Romario was one of the best players of all time IMO. That might sound slightly contradictory, but what I mean to say is that Romario was so good at what he did i.e. as an out-and-out goalscorer that it makes him a slightly superior player IMO. Just a shame that he never stayed in one place long enough in Europe to become a real club legend somewhere.

Roberto Baggio was the reason I started playing and loving the game. he was a genious. Romario scored loads of goals, but his type wasn’t anything special. Ronaldo was better than him. Baggio had it all. he was as creative as Zidane, and score as many goals as Van Nistelrooy. he did have two bad seasons at Milan, but the entire team, although it was full of great players then, were struggling. He also suffered at Inter because of his feud with Lippi.
But when he was free to do what he could have, he proved his class. at fiorentina he was a god, at Juve he was a god. came second the Bierhoff for most goals when he was at Bologna…yeah Bologna and had Brescia pushing for European spots.

I really liked Romario too but ill be honest here- i only ever really saw him play for Brazil so im not sure if thats enough to base my opinion of him on.
Cantona was great, very skillful but he never showed for the big european games (im sure man utd fans will disagree but thats my opinion anyways)
So Baggio is number one out of those, way out in front.

What should be done about a girl that leads my son on and then tells him they need a break?
I know she is going to come around again when she gets lonely and needs something. My son is 20 and has liked this girl for 2 years. Hey, we don’t always make the right choices for ourselves. She is 15. He realized that it is best to wait to date a girl once she turns 18. This girl is immature in a lot of ways and needs those 3 years. When she goes places with my kids and their friends, she always hops in the front seat of my son’s truck. She always whines and cries to him that her peers don’t like her and do mean things to her and he consoles her constantly. She tells him that he makes her happy. She would text him all the time and well, we all thought that eventually she would be the one once she well, matured? This past Christmas my son gave her a beautiful sterling and amethyst pendant and earring set to show his admiration towards the girl. She would not wear it. She told him they needed to take a break, tho they have not been on a "date" as yet, just out with a group of friends. Yet, she said how much she LOVES the jewelry and that it is her favorite stone. Now, the first thing I thought is, that she should have politely said that she loves him as a friend but does not feel the same way and that she would not feel right about accepting the jewelry. Am I right? I know I am ! Instead she tells him that she is not interested in him and that’s just the way it is. Just as cold as can be. WOW! My son doesn’t want the jewelry or to see her; he is not interested in any conversation with her now, 2 months after the fact. He is really hurt but tries not to show it.
She leads him on, takes the expensive jewelry, then tells him she wants to take a break. Now she ignores him. He used to take her to and from piano lessons and used used used him and my daughter and her boyfriend and us. We catered to her and her brother. Now we get slapped in the face by her and her family for being nice. How strange they are. No wonder her peers do not like her.
I REALLY feel that she should give back the jewelry so my son can get his money back at least. She said she was giving him a "handmade" Christmas gift but never did. Her brother did not reciprocate after receiving gifts from my kids and daughter’s boyfriend. They gave them nice gifts. It is disheartening to see your family get used. My kids have learned a hard lesson. They will hopefully be wise in their decisions from now on. And for you all out there who have also been rejected after wearing your heart on your sleeve. All of the choices are correct. He’s destroying himself (Character V. Self) because by destroying Hindley he destroys Catherine who he loves and that would be like destroying himself. Character V. Character because he hates Hindley. Character V. Nature because it was human nature for Cathy to marry Earnshaw and not him. And Character V. Society because alot of the issues between hindley and Heathcliff have to deal with society and the community they live in.
